The Bankruptcy and Diligence etc. (Scotland) Act 2007 received Royal Assent on 15 January 2007. This major piece of legislation will have wide ranging impacts both in bankruptcy and diligence. The main points are summarised on the right.

The main provisions of the 2007 Act are:

  • Automatic Discharge on Bankruptcy after one year
  • Jurisdiction in bankruptcy exclusive to Sheriff Court
  • Low income/low asset debtor petitions for sequestration
  • New Diligences
  • Land Attachment
  • Money Attachment
  • Residual Attachment
  • Interim Attachment
  • Warrant to Inhibit competent in Sheriff Court
  • Debt packs to be issued before most diligences.
